Terms of Service

Please read these Terms of Service carefully before using Church Graphics. By using our platform, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using Church Graphics ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including visitors, registered users, and subscribers.

2. Description of Service

Church Graphics is an AI-powered design platform that enables churches and ministries to create professional-quality graphics, including sermon series artwork, social media posts, event flyers, and print materials. The Service includes both free and paid subscription tiers with varying features and usage limits.

3. User Accounts

To access certain features, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions & Billing

Paid subscriptions are billed on a monthly or annual basis, depending on your selected plan. Payments are processed securely through Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are available within 14 days of your initial subscription purchase. AI generation credits reset at the beginning of each billing cycle and do not roll over.

5. Content Ownership

You retain full ownership of all content you create using Church Graphics, including generated graphics, uploaded brand assets, and project data. By using the Service, you grant Church Graphics a limited license to process and store your content solely for the purpose of providing the Service. We do not claim any intellectual property rights over your content.

6. Acceptable Use

You agree not to use Church Graphics to: (a) generate content that is harmful, threatening, abusive, or discriminatory; (b) violate any applicable laws or regulations; (c) infringe on the intellectual property rights of others; (d) distribute malware or spam; (e) reverse-engineer or attempt to extract our AI models; or (f) resell or redistribute the Service without authorization.

7. AI-Generated Content

Graphics generated by our AI tools are created using machine learning models. While we strive for high quality, we cannot guarantee that AI-generated content will be free from errors, artifacts, or unintended elements. You are responsible for reviewing and approving all generated content before use. We recommend verifying that generated text, imagery, and designs meet your ministry's standards before publishing.

8. DMCA / Copyright Takedown

Church Graphics respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (17 U.S.C. § 512) and respond to properly-formed notices of alleged copyright infringement. Filing a notice. If you believe content on the Service infringes your copyright, send a written notice to our designated agent that includes: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material with information reasonably sufficient to permit us to locate it (project ID, URL, or screenshot); (d) your contact information (name, address, phone, email); (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner. Counter-notification. If your content was removed in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g) to the same agent. Your counter-notification must include the elements required by the statute. Repeat infringers. In appropriate circumstances and at our discretion, we will terminate the accounts of users who repeatedly infringe the copyrights of others. False claims. Knowingly making a material misrepresentation in a DMCA notice or counter-notification may subject you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control, including but not limited to natural disasters, third-party service outages, or cyberattacks.

10. Limitation of Liability

To the maximum extent permitted by law, Church Graphics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

11. Termination

Either party may terminate this agreement at any time. Upon termination, your right to access the Service ceases immediately. We will retain your data for 90 days after termination to allow for data export, after which it will be permanently deleted. Provisions that by their nature should survive termination shall remain in effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes constitute acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
